Driver Terms & Conditions

These Terms and Conditions govern the relationship between BATransfer.com and drivers operating as self-employed independent contractors through the BATransfer.com platform. By registering, logging into the Driver App, accepting jobs, or completing bookings, you confirm your acceptance of these Terms.

1. Driver Status

  • Drivers are self-employed independent contractors.
  • No employment, worker, partnership, or agency relationship exists with BATransfer.com.
  • Drivers are responsible for their own taxes, National Insurance, insurance, licences, fuel, maintenance, and business expenses.

2. Driver Eligibility and Licensing

Drivers must maintain:

  • Valid driving licence.
  • Valid Private Hire Licence where required.
  • Valid Hire & Reward Insurance.
  • MOT certificate where applicable.
  • Vehicle licensing compliance.
  • Any local authority licensing requirements.

Drivers must immediately notify BATransfer.com of any suspension, revocation, expiry, or restriction affecting their ability to provide services.

3. Vehicle Standards

Vehicles must:

  • Be clean internally and externally at all times.
  • Be safe, roadworthy, and professionally presented.
  • Have working seat belts, lights, brakes, tyres, and safety systems.
  • Meet all licensing and legal requirements.
  • Be maintained to a standard suitable for airport transfer passengers.

BATransfer.com may request vehicle inspections or photographs at any time.

4. Child Seats and Passenger Safety

Drivers must:

  • Maintain child seats in a clean and safe condition.
  • Ensure child seats are fitted correctly.
  • Remove damaged child seats from service immediately.

Where children are travelling:

  • Child locks should be activated where appropriate.
  • Drivers should take reasonable precautions to ensure children's safety.
  • Drivers should ensure parents or guardians are ready to supervise children before unloading luggage.
  • Child safety remains a priority throughout the journey.

5. Accessibility, Assistance Dogs and Pets

Drivers must:

  • Accept recognised assistance dogs, guide dogs, hearing dogs, and other legally recognised assistance animals.
  • Not refuse disabled passengers accompanied by assistance dogs except where a lawful exemption applies.
  • Provide reasonable assistance to disabled passengers where appropriate.

For pet-friendly bookings:

  • Drivers should transport pets safely and professionally.
  • Follow reasonable instructions from passengers regarding pet handling.
  • Maintain vehicle cleanliness and hygiene.
  • Passengers remain responsible for the behaviour and supervision of their pets.

6. Job Allocation

  • Jobs are displayed through the Driver App.
  • The fare is displayed before acceptance.
  • Drivers may freely accept or reject jobs.
  • Acceptance confirms agreement to undertake the journey at the displayed fare.

7. Commission

  • BATransfer.com deducts commission from completed bookings.
  • Current commission rate: 25%.
  • Drivers receive the remaining balance.
  • Commission rates may be amended upon notice.

8. Airport Transfers

Drivers must:

  • Monitor flight arrivals where details are provided.
  • Attend the correct pickup location.
  • Follow airport regulations and procedures.
  • Carry passenger name boards where required.
  • Provide professional meet-and-greet services.
  • Assist passengers with luggage where reasonable and safe.

9. Customer Service Standards

Drivers must:

  • Be polite, professional, and respectful.
  • Dress appropriately.
  • Assist passengers reasonably.
  • Follow lawful dispatch instructions.

Drivers must not:

  • Smoke or vape during bookings.
  • Consume alcohol or drugs before or during work.
  • Behave abusively, aggressively, or discriminatorily.

10. Customer Contact Restrictions

Drivers may contact passengers only regarding an active booking.

Drivers must not:

  • Contact passengers for personal reasons.
  • Request future private bookings.
  • Promote competing services.
  • Use passenger information for marketing.
  • Retain customer details for personal use.

11. Non-Solicitation

  • Customers introduced through BATransfer.com remain BATransfer.com's goodwill and property.
  • Drivers must not divert customers away from the platform.
  • This restriction applies during service and for 24 months after termination.

12. GDPR and Data Protection

Drivers must:

  • Comply with UK GDPR and the Data Protection Act 2018.
  • Protect customer information.
  • Report data breaches immediately.
  • Use customer information only for booking purposes.
  • Delete customer information when no longer required.

13. Confidentiality

Drivers must not disclose or misuse:

  • Customer databases.
  • Pricing structures.
  • Dispatch procedures.
  • Software systems.
  • Operational methods.
  • Business information.

14. Lost Property

Drivers must:

  • Check vehicles regularly.
  • Report lost property immediately.
  • Safeguard customer belongings.
  • Cooperate in returning items.

Drivers must not:

  • Keep, use, sell, dispose of, or interfere with passenger property.

15. Payments

BATransfer.com may:

  • Adjust payments.
  • Recover overpayments.
  • Withhold funds pending investigation.
  • Recover losses caused by fraud or serious breaches.

16. Complaints and Investigations

Drivers must cooperate fully with:

  • Customer complaints.
  • Safety investigations.
  • Regulatory enquiries.
  • Internal reviews.

17. Driver Conduct

Drivers must not:

  • Commit fraud.
  • Falsify journey information.
  • Share driver accounts.
  • Allow unauthorised drivers to undertake bookings.
  • Engage in unlawful activities.

18. Technology Platform

Drivers must not:

  • Interfere with the Driver App.
  • Access unauthorised data.
  • Circumvent security systems.
  • Use automated software, bots, or scripts.

19. Intellectual Property

All software, websites, applications, logos, trademarks, branding, databases, and dispatch systems remain the exclusive property of BATransfer.com and may not be copied, modified, or reverse engineered.

20. Service Availability

BATransfer.com does not guarantee:

  • Continuous app availability.
  • Internet connectivity.
  • GPS accuracy.
  • ETA accuracy.
  • Availability of bookings.

21. Accidents, Breakdowns and Emergencies

Drivers must immediately notify BATransfer.com of:

  • Road traffic accidents.
  • Vehicle breakdowns.
  • Passenger injuries.
  • Medical emergencies.
  • Vehicle defects.
  • Fire incidents.
  • Police involvement.

Where appropriate, drivers must also contact:

  • Police.
  • Ambulance Service.
  • Fire & Rescue Service.
  • Highway Authorities.
  • Breakdown Recovery Services.

Drivers must:

  • Prioritise passenger safety.
  • Cooperate with emergency services.
  • Provide photographs, incident reports, insurance references, and police references where applicable.

22. Waiting Time and Additional Charges

Drivers must not demand or collect unauthorised charges directly from passengers.

Where waiting time, tolls, parking fees, airport fees, cleaning charges, additional stops, or other charges may apply, drivers must:

  • Notify BATransfer.com immediately.
  • Obtain approval where required.
  • Provide supporting evidence where requested.

Drivers must not argue with passengers regarding additional charges.

23. Passenger Comfort and Vehicle Environment

Passenger comfort remains a priority. Unless requested by the passenger:

  • Music should be switched off or kept at a very low volume.
  • Radio should be switched off or kept at a very low volume.
  • Loud conversations should be avoided.
  • Videos or audio content should not disturb passengers.

Drivers should accommodate reasonable requests relating to music, air conditioning, heating, and vehicle comfort.

Drivers should recognise that passengers may be tired from long flights, elderly, vulnerable, unwell, or sensitive to noise.

24. Professional Conduct During the Journey

Drivers must:

  • Drive safely and smoothly.
  • Avoid aggressive driving.
  • Avoid unnecessary use of the horn.
  • Maintain professionalism at all times.

Drivers should avoid potentially offensive discussions involving politics, religion, discrimination, or other sensitive subjects unless initiated by the passenger.

25. Suspension

BATransfer.com may suspend accounts for:

  • Safety concerns.
  • Fraud.
  • Insurance lapses.
  • Expired licences.
  • Serious complaints.
  • Breaches of these Terms.

26. Termination

BATransfer.com may terminate access immediately for serious breaches. Drivers may stop using the platform at any time.

27. Liability

BATransfer.com acts solely as a booking and dispatch platform. Drivers remain responsible for:

  • Driving conduct.
  • Passenger safety.
  • Vehicle operation.
  • Road traffic compliance.
  • Insurance obligations.

28. Limitation of Liability

BATransfer.com shall not be liable for:

  • Indirect losses.
  • Loss of profits.
  • Business interruption.
  • Data loss.
  • Third-party software failures.
  • Internet outages.

29. Changes to Terms

BATransfer.com may amend these Terms at any time. Continued use of the platform constitutes acceptance of revised Terms.

30. Governing Law

These Terms are governed by the laws of England and Wales. The Courts of England and Wales shall have exclusive jurisdiction.

31. Acceptance

By registering, logging into the Driver App, accepting jobs, or completing bookings through BATransfer.com, the driver confirms acceptance of these Terms and Conditions.
